Overseas Pakistanis Khula Procedure as under according to Family Laws of Pakistan. When ever any one Pakistani or Foreigner women can like to get Khula Decree from Pakistan two ways to proceed.
Khula Procedure Through Special Power of Attorney
In case of a women living abroad and her marriage registered in Pakistan and she like to dissolve the marriage on the basis of Khula decree from Family Court. She have to appoint a person in Pakistan as Special Power of Attorney and get attestation from Nearest Pakistan High Commission / Embassy / Consulate and send following documents in hard copy via courier.
- 1. NICOP Copy
2. Passport Copy
3. Nikah Nama Copy
4. Special Power of AttorneyHere in Pakistan special Power of attorney re attest / counter signed from Ministry of Foreign Affairs and Suit filled in Family court.
Court order for summons to the second party and proceeding start after around 3-4 Months Family court issue Khula Decree.Arbitration Counsel Procedure
After receiving Khula decree application along with following documents to be submit in Arbitration Counsel. Normally where women last reside or Nikah Nama Registered.
1. Certified Decree Order by Court
2. CNIC
3. Copy of Special Power of Attorney
4. Application
5. Nikah Nama Copy
Therefore In arbitration Counsel 90 days proceeding and after 90 days Chairman Arbitration Counsel will issue Talaq Moasir Certificate
After issuance of Talaq Moasir Certificate Another application along with documents mentioned above need to submit for NADRA Divorce Certificate and after 4 working days It will be issued.
Note: Time duration in family court not fix. Its depends on defendant appearance If he appear then normally decree issued in short time some time in only a Month. In case the defendant not appear then 3 notices dates and a newspaper as date took time. Hence Ex-Partee proceeding declared. Due to Ex-Partee evidence up to 4 Months time keep in mind.
However Overseas Pakistanis from USA, UK, Canada, Australia, Germany, Malaysia, United Arab Emeritus (Dubai, Abu Dhabi), Saudi Arabia and All other countries where Pakistan High Commission available.
