Permission for Second Marriage from Union Council Chairman

(1) No man, during the subsistence of an existing marriage, shall, except with the previous permission in writing of the Arbitration Council, contract another marriage, nor shall any such marriage contracted without such permission be
registered under this Ordinance.
(2) An application for permission under sub-section (1) shall be submitted to the Chairman in the prescribed manner, together with the prescribed fee, and shall state reasons for the proposed marriage, and whether the consent of existing wife or wives has been obtained thereto.
[(2A) The Nikah Registrar or the person who solemnizes a Nikah shall accurately fill all the columns of the nikahnama form with specific answers of the bride or the bridegroom.]
(3) On receipt of the application under sub-section (2), the Chairman shall ask the applicant and his existing wife or wives each to nominate a representative, and the Arbitration Council so constituted may, if satisfied that the proposed marriage is necessary and just, grant.

How to Apply

Here are Steps to Apply Online for Power of Attorney

1. Account Creation

Applicant to create an account using a valid email address. Authenticate the email address using One-Time Password (OTP) sent on email. Applicant will access the PoA Portal to create their account by providing their e-mail address along with other details.

2. Applying for POA

Once successfully signed up and authenticated (via OTP), the executor can Apply Online for PoA by submitting required documents. Apply for the Online PoA by submitting the following details:
Details of Applicant, two Witnesses and Attorney (Picture, CNIC details, etc.)
Upload Original Power of Attorney (Duly Signed by the Executor and with thumb impressions) in a scanned form. Unsigned copies will not be accepted and application will be rejected by the Consulate.
Upload other supporting documents, for example, any affidavits required
(scanned copy).

3. Biometrics

Download the following fingerprint forms for Biometric Verification
1x Biometric Verification Form for Applicant(s).
2x Biometric Verification Form for your Witnesses.
Note: In case of more than one applicant, each applicant needs to complete their respective Biometric Verification Form. These forms are partially pre-filled with details of Applicant and Witnesses
Each form needs to be filled by the respective individuals to whom the form belongs.
Applicant and Witnesses will provide their fingerprints in the required boxes.
Applicant and Witnesses need to read all declarations before signing the form.
Scan & Upload the completed form into the POA system.

4. Fee Payment

You will receive the status of Biometric verification.
Upon successful verification, you will be required to make the Online Fee payment against your application, using Credit or Debit card only.
Once the payment is complete, successfully verified and paid applications will proceed to the Online Video Interview.
In case of biometric failure, you will be provided 4 chances of re-uploading the new Biometric Verification forms. If the biometrics do not verify after these 4 attempts. You will physically visit the nearest Pakistani Mission Abroad. In this case, the witnesses also need to accompany you to the Pakistan Mission/Consulate in person.
Any foreigner (person not holding NICOP/POC/CNIC/Pakistani Passport) executing legal instrument/document also needs to visit the Pakistan Mission/Consulate in person.

5. Video Interview

Upon successful verification, you will be provided the time and date along with a link for the online Video Interview.
The Consular Officer will schedule and conduct the online Video Interview with you (the Applicant) to determine the final decision on the case.
At the time and date, the Applicant along with the Witnesses must attend the Online Interview to answer any queries of the concerned officer.
Due to The concerned Consular Official of the Pakistani Missions Abroad will take the final decision on the case.

6. Final Consent

Upon successful approval of the Consular Officer, the system will alert via email to acquire Applicant(s) Final Consent against the application.
Hence The applicant(s) must provide this final consent within 15 days of receiving this email.  Failure to do so  result in application being reject.
Upon consent. So the system shall inform you to print the receipt details of your successful application including case ID, Applicant(s), witness and Attorney details, details of official approving case officer etc.
Print the downloaded receipt and physically dispatch this receipt along with the Power of Attorney document to the Attorney.
The Attorney upon receiving the receipt and POA in Pakistan, can then proceed to visit the MoFA Office.

Divorce Procedure in Pakistan when husband can divorce to his wife as under

Divorce By Husband

Marriage is a civil contract that a husband or a wife can dissolve at any time. Both men and women have the right to dissolve this contract.

The process of talaq for male and female is different. Everyone should know about the legal divorce procedure in Pakistan. When a man dissolves this contract, it is the “divorce by the husband”. Divorce is a legal dissolution of marriage and it should be done by a court. When a husband divorces a wife, he dissolves his marriage by pronouncing in written format. Marriage is a contract and it also dissolves like any other contracts. A husband has an independent right to divorce. There are some necessary steps to follow if you want a legal procedure. It is, therefore, important to follow some legal procedures for the pronouncement of divorce. It is also very essential that the woman collects her talaqnama certificate from the Union Council as proof.

According to the Muslim Family Law Ordinance 1961 (MFLO), there are certain formal requirements for recognizing full divorces.

The provisions of section 7 of the Muslim Family Laws

In Short The provisions of section 7 of the MFLO are as follows:

A man who intends to divorce his wife after the pronouncement of Talaq sends a written notice of divorce to the Chairman. Furthermore, he has to provide a copy to the wife.

A person is punishable if he contravenes the provisions of subsection (1). Hence there will be simple imprisonment for a term or may have to pay a fine up to 5000 rupees or with both.

Save as in subsection (5) divorce unless revoked previously, is not effective until the expiration of 90 days from the date the union council receives the notice of divorce.

Within thirty days, union council receives the notice of divorce, the union council constitutes an Arbitration Council to settle the matter between the parties and it, therefore, takes all important steps to reconcile this matter.

If the wife is pregnant at the time of pronouncement of divorce, divorce shall be ineffective until the period described in sub-section (3) or the pregnancy ends.

But After the period of 30 days is over, the union council, therefore, issues a certificate of divorce.

A Verbal Divorce

The law does not recognize a verbal divorce. Moreover, if the husband fails to send a written notice to the Union Council, then this divorce is ineffective by law. Furthermore, if a wife does not receive a proper certificate of divorce by the Union Council, the divorce is challenge able. The purpose of this law is to protect women from an immediate and unrecorded divorce.

Serving The Notice To The Wife

So A wife can receive a notice of divorce (with the Union Council’s permission) through her parents or adult brother or sister only. However, other relatives cannot serve the notice to the woman. If due to any condition, it is not possible for parents or adult sister or brother to serve the notice, the husband can serve notice through a newspaper.
